| September 24, 2007 | | Flagstaff Homeowners Associations Cannot Prohibit Solar Devices | Flagstaff homeowners may now use solar devices even if their property is governed by a homeowners association. Senate Bill 1254 on "solar energy devices" was signed by Governor Napolitano became effective September 19, 2007. The new law stipulates that a Homeowner Association shall not prohibit the installation or use of energy devices (panels and associated devices). Still, an HOA may adopt reasonable rules regarding the placement of solar devices so long as those rules do not either prevent the installation of the device, impair the functioning of the device, restrict its use, or adversely affect the cost or efficiency. Homeowners in the Flagstaff area are successfully using solar panels and wind turbines to generate electricity for their homes, and if the home is “on the grid” are selling electricity to Arizona Public Service. | |
